The Ministry of Culture has begun preparing bills designed to tighten anti-piracy legislation. According to Kommersant with reference to “Federal portal of draft regulatory legal acts“, Officials want to reduce the time for removal of pirated content and introduce new fines for its non-removal.
The full text of the documents has not yet been published, it is only known that the first law is an amendment to the Code of Administrative Offenses. They will include new fines for failure to comply with the requirements of Roskomnadzor to remove pirated content at the request of the copyright holder. The second project aims to reduce the time it takes to remove content.
Currently, hosting providers are given three business days to block pirated content after a court decision, and the penalty for non-execution reaches 700 thousand rubles (in case of repeated violation – up to 3 million rubles).
The planned date for the entry into force of the amendments is December 20, 2023.
Some market participants were skeptical about the initiative of the Ministry of Culture.
“How can a pirate who is hiding his legal entity and identity be fined?” One of them says.
Eduard Kisiev, Head of Legal Services at Aeroplan Company (Fixics brand), in turn, believes that the increase in fines should be tangible, saying that “only drastic measures will help to protect intellectual property rights to a new level.”
Tired of waiting for a court decision, market participants have developed their own pre-trial blocking mechanism. It consists in the following: since November 2018, search engines have removed links to pirated content from the issuance of copyright holders as part of the so-called anti-piracy memorandum. The agreement was signed by the largest television holdings, producers and Internet companies. It was assumed that the memorandum would become the basis of a law that has not yet been issued. Recently, the document was extended until January 2023.
