The artist accused Capcom of illegal use of her photos – the creators of Resident Evil and Devil May Cry awaits trial

Independent artist and designer Judy Jurachek filed a claim against Capcomby accusing the Japanese company of stealing its published copyrighted materials and their subsequent commercial use in a number of game projects, including Resident evil 4 and Devil may cry

In particular, Yurachek blames artists from Capcom in the deliberate use of materials from their artbook Surfaceswhich she first published back in 2016.

According to the plaintiff, her book, supplied with the CD, contains over 1,200 photos various surfaces that artists around the world can use for teaching or as artistic references. Yuracek also allows direct use of her photographs for commercial projects, however, the author requires that such decisions be discussed with her individually.

As evidence of her accusations against Capcom, Judy Juracek compiled a large-scale document of more than one hundred pages – it contains dozens of examples of Capcom artists using Surfaces artbooks in different games. The photographs of Jurachek were allegedly used to depict various surfaces, design elements and even when creating a logo. Resident evil 4

Last year’s hacker attack on Capcom’s internal servers provided significant assistance in preparing the Judy Juracek case. As it turned out, they still contain a huge amount of source codes from old games, to which Jurachek is now referring. The plaintiff also draws the court’s attention to the fact that one of the “problem” files on the Capcom server has a name that is completely similar to the marking of the photo from the Surfaces artbook, which should once again prove the validity of the claim.

According to the plans of lawyers Judy Juracek, the designer can claim compensation from Capcom in the amount of up to $ 12 million, as well as individual payments in amounts from 2,500 to 25,000 dollars for every illegal image used.

According to the publication Polygon, representatives Capcom are aware of the claim, but are not yet ready to give any comments.
