The essence of the claim boils down to the fact that, in the opinion of the dissatisfied players and the lawyers representing them, the wording Bethesda regarding the seasonal pass for Fallout 4 misled the audience. In the description of the add-ons for the famous role-playing game, it was indicated that its purchase “will give you access to all additional content“.
At the same time, in the primary post-release period, the authors Fallout 4 held back – all Season Pass buyers could download new add-ons as new add-ons were released at no additional cost. but in 2017 Bethesda announced the release of another wave of materials for Fallout 4 – add-ons distributed through the service Creation Club… And it is to this step of the publisher that the lawyers X-Law Group trying to attract the attention of the court.
According to the plaintiff, materials from the service Creation Club (created by both users and team Bethesda Game Studios) fall under the characteristic “additional content for Fallout 4“and therefore should be available to all Season Pass holders and not be distributed at an additional cost.
In favor of a claim by X-Law Group also says a number of subtle legal factors. For example, in the end user agreement Fallout 4 there is no clause on the exact conditions of distribution and availability of this or that downloadable content. In turn, the description of the game’s seasonal pass did not specify the full list of additions and their final release schedule. Based on this, lawyers believe that the materials Creation Club really should be part of Season Pass…
It is noteworthy that against the background of a potential trial, lawyers X-Law Group also admit the possibility of petitioning the court for a temporary freeze of the merger ZeniMax Media and Microsoft… Lawyers do not exclude that against the background of a large-scale transaction, players’ complaints about additional content for Fallout 4 may not be satisfied in any way.
If the case gets a move, the final court decision could be made by 2023. At the same time, the potential amount of damage from Bethesda can be estimated in $ 1.1 billion excluding additional costs…
On the other hand, according to independent experts, the conflict between players and Bethesda can be settled peacefully. Experts see the most favorable outcome as a scenario in which developers will make concessions and open access to materials Creation Club to all Season Pass holders Fallout 4, and they themselves will calmly become a part Microsoft on time.
