Publishing house Little orbit intends to sue the Texas studio Descendent studios, which could not complete the development of the prequel of the cult space shooter Descent. The lawsuit was filed in January 2023: the company accuses the head of the studio Eric Peterson breach of contract, fraud, defamation, and so on.
Descendent studios was formed in 2014 by several immigrants from the studio Cloud imperium games. Specifically, Eric Wingman Peterson was one of the key developers. Star citizen (served as president of development) and worked under Chris Roberts from the time of Wing commander. He also led the acclaimed fans of the show. Wingman’s hangar, however, the popularity of the developer, apparently, did not like Roberts and his wife Sandy gardiner. As a result, Peterson began to be pushed aside, the show was replaced by another (with the participation of Gardiner), after which he left to do his project.
The new development team decided not to trifle, having launched into production Descent: Underground. For the sake of this, in 2015 Descendent Studios received the rights to the series from Interplay, and also raised about 600 thousand dollars for development through Kickstarter.
In 2017, the studio also received an investment from Little Orbit. According to the agreement, the game was supposed to be released on PC and consoles, however, the developers managed to skip several deadlines at once, the last of which was scheduled for February 2019.
The publisher claims that the content developed by Descendent Studios did not meet quality standards, which is why third-party studios had to be involved. In addition, Little Orbit suspects that Interplay has revoked its previously issued license. As for Eric Peterson, he made a series of false and “humiliating” statements for the publisher, trying to justify before the players and backers for their own failures and shift the blame on partners.
The damage from Descendent Studios is estimated at a minimum of at least two million dollars. Little Orbit also intends to take away all the intellectual rights to Descent: Underground.
