Australian Supreme Court fines European unit Sony Interactive Entertainment Network on the 2.4 million dollars because the company refused to refund money to gamers who bought in a digital store Playstation store defective games.
A statement was filed in court by the Australian Competition and Consumer Protection Commission (ACCC) back in May 2019, accusing Sony Interactive Entertainment Network Europe in violation of local law. According to the rules PS Store, the game cannot be returned if the user managed to download it to the console or more than 14 days have passed since the purchase. This is contrary to the law of the country, which says that digital purchases are subject to the same guarantee as physical ones, and therefore the claim was satisfied.
“What Sony told these people is a lie and does not reflect the true warranty provided to the people of Australia in accordance with the laws of the country.” Consumers who purchase digital products online have the same rights as when buying in a regular store. The guarantee cannot end after downloading the digital product or 14 days after its purchase, as well as on any other arbitrary date declared by the game store or developers, “said ACCC President Rod Sims.
The court also found that Sony Europe violated the law by notifying one of the buyers that she was not obligated to reimburse him for a defective game without the permission of the developers. At the same time, the company approved a refund to another player, but only in the form of a virtual currency for the PS Store wallet.
“If the buyer initially paid in cash or by money transfer, then the funds should be provided in the same form upon return, unless the consumer himself agrees to receive them in the form of loans [виртуальной валюты] for the store. “
Sony is currently preparing to release Playstation 5, sales of which are planned for the holiday season of this year.
